<p style="margin-bottom: 24px;">Welcome to Octave. By accessing, compiling, deploying, or utilizing the Octave client-side software application (the "Software"), you explicitly acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must immediately cease usage and delete all instances of the Software from your devices.</p>
<h3 style="color: var(--text-primary); margin-bottom: 12px; font-size: 18px;">2. Open Source License (MIT)</h3>
<p style="margin-bottom: 24px;">The source code of the Octave interface is proudly open-source and is distributed under the <strong>MIT License</strong>. You are granted permission, free of charge, to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software. However, this license applies <em>only</em> to the source code of the interface written by the developer. It does absolutely not grant you any rights, licenses, or permissions to the copyrighted audio, video, lyrics, or metadata that may be accessed or streamed <em>through</em> the Software.</p>
<h3 style="color: var(--text-primary); margin-bottom: 12px; font-size: 18px;">3. Trademarks and Branding</h3>
<p style="margin-bottom: 24px;">While the code is provided under the MIT License, the name "Octave", associated logos, and specific branding assets remain the intellectual property of the original developer. You may not use the "Octave" name or branding in any derivative works or commercial distributions in a way that implies endorsement, sponsorship, or affiliation with the original developer without explicit prior written consent.</p>
<h3 style="color: var(--text-primary); margin-bottom: 12px; font-size: 18px;">4. Zero-Hosting Policy & DMCA Safe Harbor</h3>
<p style="margin-bottom: 24px;">Octave acts entirely as a decentralized, client-side graphical user interface (GUI). The Software <strong>does not host, store, copy, transcode, upload, or distribute</strong> any copyrighted media or audio files. All streams, images, and metadata are requested dynamically by the user's local browser from decentralized, third-party public APIs (such as public Invidious instances and LRCLIB). Because the Software operates purely as a passive proxy tool facilitating user-initiated requests, the developers and maintainers of Octave bear zero legal liability for the content accessed. Any Digital Millennium Copyright Act (DMCA) takedown notices or copyright grievances must be directed toward the external servers and APIs actually hosting the infringing content.</p>
<h3 style="color: var(--text-primary); margin-bottom: 12px; font-size: 18px;">5. Third-Party API Reliance</h3>
<p style="margin-bottom: 24px;">The core functionality of Octave depends entirely on the availability and stability of third-party public APIs. The developers have no control over these external services. We do not guarantee continuous access, uptime, or quality of service. If these third-party APIs change their structure, implement strict rate-limiting, block access, or shut down entirely, the Software may cease to function. The developer is under no obligation to provide patches, updates, or alternative API routes to restore functionality.</p>
<h3 style="color: var(--text-primary); margin-bottom: 12px; font-size: 18px;">6. Absolute Data Privacy</h3>
<p style="margin-bottom: 24px;">Octave is designed with absolute data sovereignty in mind. There are no backend databases, user accounts, cookies, or tracking pixels. Every piece of data—including playlists, listening history, settings, and search queries—is stored locally on your device via the browser's native `localStorage`. The developers collect zero telemetry or Personally Identifiable Information (PII). Consequently, clearing your browser's local storage will permanently delete your Octave data. The developer cannot recover lost data under any circumstances.</p>
<h3 style="color: var(--text-primary); margin-bottom: 12px; font-size: 18px;">7. Disclaimer of Warranties</h3>
<p style="margin-bottom: 24px; text-transform: uppercase; font-size: 13px;">The Software is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall the authors or copyright holders be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Software or the use or other dealings in the Software.</p>
<h3 style="color: var(--text-primary); margin-bottom: 12px; font-size: 18px;">8. Limitation of Liability & Indemnification</h3>
<p style="margin-bottom: 24px;">By deploying, hosting, or utilizing this Software, you agree that you are solely responsible for your actions. You agree to indemnify, defend, and hold harmless the developer from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your violation of these Terms, your deployment of the Software, or your infringement of any third-party intellectual property rights through your usage of the tool.</p>
